Baghdadi Mahmoudi's extradition reveals constitutional conflict.
Following the extradition of Baghdadi Mahmoudi to Libya by order of Prime Minister Hamadi Jebali the President Moncef Marzouki protested that it was his prerogative to decide on the matter.

In the Constituent Assembly yesterday 73 members from the Ettakattol and CPR signalled they would submit a
censure motion against the government. They protested loudly when the speaker refused to accept the motion for the current session and postponed it to Friday when the Prime Minister would be present. They sang the national anthem and walked out of the session. Infact they do not have the numbers necessary to carry a successful motion and this reveals the weakness of their situation. Ennhada has 89 of the 217 assembly seats, far more than any other party.
After the Constituent Assembly elections on 24 October 2011 it was agreed that all the powers of the former president would be vested in the prime minister to avoid the posibility of a dictatorship. However it means that the interim government is essentially a balancing act waiting for the Constituent Assembly to agree a constitution to define the powers of the President and Prime Minister.
Infact the dispute over Baghdadi's extradition is one of many disputes of civil rights and liberties which has been notably highlighted by frequent and violent Salafist demonstrations.
Tunisians have yet to agree what kind of society they want to live in. The high level of unemployement at well over 700,000 has caused considerable discontent.The strains on the ruling troika are evident.
As the extradition of Baghdadi Mahmoudi cannot be reversed and it is unlikely that he will face trial at the ICC,a compromise will no doubt have to be agreed but the underlying weakness of the political situation in Tunisia will remian for the interim government. Hamadi Jebali recently said that it was possible that an election could be held before March 2013, and that the consitution had to be completed, adding "the sooner the better."
