ICC orders Libya to deliver Abdullah al-Senoussi

The International Criminal Court (ICC) on Thursday ordered Libya to surrender the former head of Libyan intelligence Abdallah al-Senussi to the ICC. It accuses Senoussi of crimes against humanity committed during the revolt that led the fall of the regime of Muammar Gaddafi in 2011.

It "ordered the Libyan authorities to immediately surrender of Mr Al-Senoussi the Court," the ICC said in a decision dated Wednesday and made public Thursday. It follows a request to that effect made by counsel for Mr. Senoussi appointed by the ICC.

This decision marks a new stage in the long dispute between the ICC and Libya , which is  competing with the Court  for the right to judge the son of Muammar Gaddafi, Seif al-Islam and Abdullah al-Senoussi, former pillar the Gaddafi regime. They are the subject of arrest warrants by the ICC.

The spokesman for the Libyan Attorney General Baara Taha, downplayed the scope of the ICC decision, which falls, according to him, in the context of "a routine procedure."

He said the Libyan authorities had filed a petition on 23  January with the ICC to judge Abdullah al-Senoussi in Libya.

"We have eight weeks from the date of the deposit of request to complete the application and submit the necessary documents," he told AFP.

"Even in case of a negative decision by the ICC, we have the right to appeal," he added, saying "Libya is to judge Abdallah Senoussi." "We have a strong justice and we have the ability to judge," he said.

Abdullah al-Senoussi and Seif al-Islam Gaddafi are in the hands of the Libyan authorities to which the ICC has repeatedly asked it to deliver the two men. The ICC is examining a request by  Tripoli demanding the right to try the two suspects in Libya.

Lawyers for Seif al-Islam Gaddafi and Abdullah al-Senoussi appointed by the ICC say that they will not have a fair trial if tried in Libya.

After the fall of the regime of Muammar Gaddafi, Abdullah al-Senoussi had fled Libya and was arrested in Mauritania with a Malian passport under a false identity. Following his arrest in March 2012, he was extradited to Libya in September 2012.

Seif al-Islam Gaddafi, also suspected by the ICC for crimes against humanity, is held by  the brigade of rebel veterans at Zintan (180 km south of Tripoli) since his arrest in November 2011.

The Security Council of the UN called on the ICC in February 2011 to investigate  crimes committed in Libya during the uprising that led, after the Western military intervention in the fall of Muammar Gaddafi and his regime .
